Terms of Service
These terms have two parts: one for café owners who use Cupcloud to run their menu and orders, and a short one for customers who order from a café's menu page.

For café owners: the service
Cupcloud gives your café its own menu page and the tools to take and manage orders. By creating an account or using the service you agree to these terms. If you do not agree, please do not use Cupcloud.

Your account
Give us correct details, keep your password safe and tell us if you think someone else has used your account. You are responsible for the staff accounts you create and for what is done with them.
Free trial
A café that signs up itself starts with a free trial, currently 14 days. No card is needed and nothing is charged automatically.
When the trial ends, your menu stops taking new orders until we activate your café. During the trial your café is not listed in our directory or offered to search engines. The price after the trial is agreed with you directly.
What your café is responsible for
Your café is the business the customer buys from. You are responsible for:
- Your menu, descriptions, photos and prices, and keeping them correct
- VAT and tax: the VAT settings you choose and your own tax obligations
- The food and drink itself: safety, allergens, licences and permits
- Your opening hours, delivery areas, fees and delivery times
- Preparing and delivering orders, and handling complaints, cancellations and refunds
- Using your customers' details only to fulfil and support their orders
Payments and no commission
Cupcloud takes no commission on your orders and never holds your money. Cash is paid to you directly. If you turn on card payment, it runs through your own payment gateway account and the money goes straight to you; your agreement for that is with the gateway.
Cupcloud is not a party to the sale between you and your customer.
Acceptable use
You agree not to:
- Use Cupcloud for anything unlawful, or to sell goods you are not permitted to sell
- Publish content that is false, offensive or infringes someone else's rights
- Try to access another café's data, or disrupt or probe the service
- Send unwanted marketing to customers using details collected for orders
- Resell the service or create accounts by automated means
Your content and your data
Your menu, photos and business records remain yours. You allow us to host and display them so the service can work. Your customers' details are handled as described in our Privacy Policy.
A small "menu by Cupcloud" credit may appear in the footer of your menu page.
The service is provided as it is
We work to keep Cupcloud available and correct, but we provide it as it is, without a guarantee that it will always be available or free of errors. We may change, add or remove features.
To the extent the law allows, Cupcloud is not liable for lost sales, lost profit or indirect loss arising from use of the service.
Suspension and ending
We may suspend or close a café that breaks these terms, abuses the service or puts other users at risk. Where we reasonably can, we will tell you first.
You can stop using Cupcloud at any time by writing to info@cupcloud.ae. On request we will give you an export of your menu and order records.
Law
These terms are governed by the laws of the United Arab Emirates, and its courts have jurisdiction over any dispute.
Changes to these terms
When we change these terms we update the date at the top. For an important change we will tell café owners by email or with a notice on the site. Continuing to use Cupcloud after a change means you accept it.
For customers who order from a café
When you order through a café's menu page, your order is with that café, not with Cupcloud. The café sets the menu and the prices, prepares and delivers your order, and handles any complaint, cancellation or refund. You pay the café — in cash, or by card through the café's own payment gateway.
Cupcloud provides the software only. Please give a real mobile number so the café can reach you, and do not place orders you do not intend to collect or pay for. A café may refuse an order.
An account you create belongs to that one café. How your details are handled is described in our Privacy Policy.
